Like many properties, their land backed onto Te Awa Kairangi / Hutt River, and they had used the intervening land as an extension of their back yard. They were one of thirty Black Beech Road households which had signed a petition against the city council's proposal to run the trail through land they had used and maintained for years.
A June 16, 2004 'Leader' article said that 'the council was legally entitled to develop a walkway along the Esplanade Reserve'; the removal of unauthorised structures including fences and buildings would be required. Residents would be given the opportunity to apply for encroachment licences. A report to the services committee would be considered by the council during the next week.
The 920-metre river walk extension had been completed, but not opened, by March 23, 2005.
